Religious schools would lose the right to expel teachers and students over their sexuality or gender identity under recommendations in a new report.

The Australian Law Reform Commission was tasked with providing a pathway to prevent discrimination against LGBT teachers and students.

Its findings put renewed pressure on the Albanese government to axe a controversial exemption for religious schools in discrimination law,

The commission's report says that religious schools should be able to operate in accordance with their beliefs, but should not be able to discriminate when it comes to hiring and school enrolment, meaning you shouldn't be able to lose your place at a school if you're trans or gay.

The commission noted that most religious institutions had no intention to discriminate, but critics of the report's findings, say they will erode faith-based education.

The report has been blasted by Christian Schools Australia as a "direct attack on faith and freedom of belief in Australia".

But Equality Australia welcomed the commission's findings, saying they would help "remove cruel and unnecessary barriers" if adopted in law.

Labor promised at the last election to change the legislation, introduced in 2020, by protecting the sexuality or gender identity of teachers and students in law.

But Prime Minister Anthony Albanese says the reforms will only proceed if they have support from the Opposition.

He insists now is not the time for another debate on the controversial issue.
