Labor soul-searching after by-election loss

Labor's Jeff Drayton concedes the party will have to do some soul searching in the wake of its crushing defeat in the NSW Upper Hunter by-election.

With just over three quarters of votes counted, Labor is staring down the barrel of a 7 percent swing away from the party.

Mr Drayton said he had called his opponent, David Layzell, to congratulate him on victory.

Mr Drayton said working class communities did not see Labor as the answer, and winning them back would take hard work.

The Electoral Commission said around 3,000 postal ballots would be counted from today.

Leadership spill brewing

The ABC understands an internal battle is brewing within NSW Labor over who will replace leader Jodi McKay, after a disastrous result in the Upper Hunter by-election.

Ms McKay said the party was shell shocked by the "terrible result" over the weekend, but indicated she won't be stepping down as she believed she should be part of the solution.

Shadow Transport Minister Chris Minns, Shadow Health Minister Ryan Park, Shadow Natural Resources Minister Paul Scully and former leader Michael Daley are considered potential candidates to replace Ms McKay as leader.

Ms McKay denied there was a challenge to her leadership. 

Wage theft inquiry

A public inquiry into the underpayment of wages is being held at NSW Parliament today.

The Finance Minister, Damien Tudehope, introduced a Bill earlier this month, looking at ways to deter so-called wages theft, with a Tax Adminstration amendment.

Mark Morey from Unions NSW, who is giving evidence, says people are being underpaid across the state.

"We know from the research we have done, in some places, particularly agriculture, people are being paid as little $2 an hour," he said.

Domestic violence hearing

The Royal Commission into violence, abuse, neglect and exploitation of people with a disability will hold a public hearing today, with a case study based in western Sydney.

The hearing will focus on three people living in a home operated by a non-government provider, Sunnyfield Disability Services.

It's expected to be the first of several hearings looking at how some providers respond when incidents occur.

New research reveals that despite the eased COVID restrictions, younger Australians are now still drinking more than they were last year.

A national survey conducted by the Alcohol and Drug Foundation has found that more than 20 per cent of Australians do not associate any harm with drinking.

This is despite new guidelines being released last December recommending people should not drink more than four drinks a day, or 10 drinks a week because of the risks of harm including injuries, dependence, and diseases like cancer.

The survey found younger people do not associate drinking alcohol with any illness or injury, and more than a quarter of 18 to 24-year-olds report they are drinking more since the COVID lockdowns.
