Sussan Ley has sensationally called for the Immigration Minister to be sacked following revelations he was promoting the Voice to Parliament amid meetings about the potential release of immigration detainees late last year.
Andrew Giles did not attend three meetings about the NZYQ High Court case ahead of the November ruling which led to the release of 149 immigration detainees, according to a report from The Daily Telegraph.
The minister was seen in a social media post promoting the Voice referendum in London while his team met with Home Affairs counsel in October, as revealed in Senate Estimates.
He was also pictured at a Voice event in Canberra on the day his staff discussed the ramifications of a High Court loss in September.
Ms Ley spoke to Sky News Australia about the issue on Wednesday, calling for the minister to be let go.
"Where was the minister, he was attending Voice rallies. I think one of those rallies were in London. He wasn’t focused on what he had to do," she told host Peter Stefanovic.
"When is this minister going to go? When is Anthony Albanese going to sack him. Clearly it needs to happen.
"And if he doesn’t sack him then this is on the Prime Minister."
Mr Giles on Monday faced a fiery Question Time grilling from the Opposition over newly-released documents which detailed the specific crimes some of the released detainees had committed.
When asked whether any of the 36 released detainees without ankle monitoring bracelets had recommitted crimes, Mr Giles said they were "operational matters" he could not comment on.
"I say again that the government established the community protection board to provide us with expert advice as to the conditions to those in the cohort," Mr Giles said.
Ms Ley said Mr Giles’ performance in the chamber was "embarrassing to watch" and questioned why the government was yet to file any re-detention applications for some of the detainees.
"They are unlawful non-citizens. They are walking our streets and this government does not know where they are and cannot give an assurance they are even being monitored," she said.
"He (Mr Giles) is completely inept and completely incompetent and it's embarrassing to watch him and just sit there and I can’t believe it.
"For two full days we have had this in the parliament and I’ve been waiting for the Prime Minister to somehow mop this up.
"It simply is a question of when Andrew Giles has to go."
The government has yet to file applications for preventative detention applications for any detainees despite rushing through new legislation to deal with the debacle late last year.
When pressed on the matter, Mr Giles said he was "working around the clock" on applications.
"We are working around the clock to ensure that applications are made as soon as possible and, critically, that applications are successful, not half-baked," he said.
